Terms of Service

These Terms of Service ("Terms") govern your use of the Zen: Daily Affirmations mobile application (the "App"), developed by DIMA S SOFTWARE SRL ("we", "us", or "our"). By using the App, you agree to these Terms.

1. Using the App

The App is a personal wellness tool for daily affirmations, inspirational quotes, and mindfulness practice. You must be at least 13 years old (or 16 in the European Economic Area) to use the App. If you are under the age of majority in your jurisdiction, you need permission from a parent or guardian.

To use the App, you need to create an account using your email address, Google Sign-In, or Apple Sign-In. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

2. Content

The affirmations, quotes, and other textual content provided through the App are curated by us or sourced from public domain works. This content is provided for personal inspiration and wellness purposes only. It is not a substitute for professional medical, psychological, or therapeutic advice.

Your personal data — including preferences, favorites, and viewing history — belongs to you. By using the App, you give us permission to store and process this data solely to provide you with the App's features.

3. Account Deletion

You can delete your account at any time by going to Settings → Delete Account in the App. When you delete your account, all of your data is permanently removed from our systems. This action cannot be undone. You can also request deletion by emailing contact@dimas-software.com.

4. Subscriptions and Payments

The App offers free content including a selection of quotes and basic features. For full access to all categories, affirmations, themes, and practice mode, you can subscribe to Zen Pro on a monthly or annual basis.

• Subscriptions are billed through the Apple App Store or Google Play Store.
• The annual subscription includes a 3-day free trial. If you do not cancel before the trial ends, you will be charged for the subscription.
• Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the current period ends.
• You can manage or cancel your subscription in your device's subscription settings.
• If you cancel, you will still have access to premium features until the end of the current billing period.
• Refunds are handled by Apple or Google according to their policies. Contact Apple Support or Google Play Support for refund requests.
• We may change subscription prices from time to time. Any price change will apply starting from your next billing period.

5. Acceptable Use

When using the App, you agree not to:

• Use the App for any unlawful purpose
• Attempt to access other users' data or our systems without authorization
• Reverse engineer or attempt to extract the source code of the App
• Interfere with or disrupt the App's operation
• Use automated tools (bots, scrapers) to access the App
• Create multiple accounts to bypass usage limits
• Redistribute, resell, or republish the App's content without permission

6. Intellectual Property

The App and all its content — including design, code, graphics, logos, affirmations, and curated quotes — belong to DIMA S SOFTWARE SRL or are used under license. We grant you a personal, non-transferable license to use the App in accordance with these Terms. You may not copy, modify, distribute, or create derivative works based on the App.

You may share individual quotes through the App's built-in sharing features for personal, non-commercial purposes.

7. Third-Party Services

The App uses third-party services such as Firebase, Google Sign-In, Apple Sign-In, RevenueCat, PostHog, and Expo. Your use of these services is subject to their own terms and privacy policies. We are not responsible for the content, availability, or practices of third-party services.

8. Disclaimers

The App is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that the App will always be available, error-free, or that any defects will be corrected.

The affirmations and quotes in the App are intended for general wellness and personal growth. They are not medical advice, therapy, or treatment for any mental health condition. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits arising from your use of the App. Our total liability for any claim related to the App shall not exceed the amount you paid us in subscription fees during the 12 months before the claim, or €50, whichever is greater.

10. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your use poses a security risk, or if required by law. If we discontinue the App, we will give you reasonable notice.

11. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the "Last updated" date at the top of this page. For significant changes, we may notify you through the App or by email. Continued use of the App after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Moldova. Any disputes will first be addressed through good-faith negotiation. If that is not successful, disputes will be resolved by the competent courts of the Republic of Moldova.

13. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following applies:

• These Terms are between you and DIMA S SOFTWARE SRL, not Apple.
• Apple has no obligation to provide support or maintenance for the App.
• If the App fails to meet any warranty, you may notify Apple for a refund of the purchase price (if applicable). Apple has no other warranty obligation.
• Apple is not responsible for any claims related to the App, including product liability, regulatory compliance, or intellectual property.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

14. General

If any part of these Terms is found to be unenforceable, the remaining parts will continue to apply. These Terms, together with our Privacy Policy, make up the entire agreement between you and us regarding the App.
